Employers, plan administrators and others are subject to dozens of reporting and disclosure requirements relating to their employee benefit plans – from automatic enrollment notices to W-2s – many of which carry stiff penalties. The ACA will require them to make new disclosures and revise their existing disclosures – in SPDs, COBRA notices and elsewhere – to reflect changes in benefits and eligibility, the availability of coverage on Exchanges, etc.

This program takes a hard look at these often-overlapping rules. The speakers provide an overview of the rules that apply to different types of plans under the ACA, HIPAA, ERISA, the Code and other statutes, and discuss ways outside and inside counsel can help streamline communications to employees in a cost-effective and compliant fashion. The program focuses in particular on the reporting and disclosures required to implement the ACA, and on the rules relating to electronic communications.
