Our Lips Are Sealed...or Are They? The Black, the White, and Shades of Grey in Model Rule 1.6

Access Activity

Overview / Abstract:

Model Rule 1.6 sets forth one of the basic principles of legal representation: you have to keep your client's confidences confidential. Using hypothetical situations, our panel of experts will help you understand the rules about what you must keep secret, what you can reveal and what do if:

The duty creates a conflict with another client
Your client uses your advice to break the law
You’re accused of conspiring with your client to commit a fraud
Your new client tells you that he or she has been injured in an auto accident and needs your help settling with the insurance company. A few months later, the government serves you with a subpoena for your records, alleging that your client was engaged in insurance fraud. Or maybe your new client comes to you with a great business plan and asks your help in getting started. A few weeks later, one of your longtime clients calls you about pursuing an ex-employee for theft of trade secrets. You realize, with a sinking feeling, that the ex-employee is your new client.

Model Rule 1.6 sets forth one of the basic principles of legal representation: you have to keep your client's confidences confidential. But what if that duty creates a conflict with another client? What if your client may have used your advice to break the law? What if you realize that you may be accused of conspiring with your client to commit a fraud? Our panel of experts will help you understand the rules about what you must keep secret, what you may reveal and what you must reveal. It's a complicated world out there, and you need to know the ins and outs of Rule 1.6 to protect your clients ... and yourself.
