The Affordable Care Act and Health Care Fraud: The Beat Goes On

Overview / Abstract:

The recent publicity involving the Supreme Court's decision to uphold the constitutionality of the Affordable Care Act ("ACA") was primarily focused on the "individual mandate" and the expansion of the Medicaid Program. The balance of the provisions of the ACA were also sustained by the Supreme Court's decision and many of them have already had a significant impact in criminal, civil and administrative enforcement of the health care fraud and abuse laws and obligations for healthcare organizations to ensure compliance with fraud and abuse and regulatory requirements under Federal health programs. This program is designed to focus on the ACA provisions having the most significant impact in the fraud and abuse enforcement and compliance areas. The topics that will be addressed during the webinar include the increased funding and expansion of Federal and state enforcement efforts and the significant amendments to the False Claims Act. The panelists will also discuss the ramifications of the "lowered intent" standard applicable for criminal liability under the Federal Anti-Kickback Statute and the establishment of the Centers for Medicare and Medicaid Services Self-Referral Disclosure Protocol ("SRDP") facilitating self-reporting of violations of the Federal Stark Law. The panelists will also address the mandatory compliance programs for healthcare organizations and, finally, a discussion of the amendments to the False Claims Act and Civil Money Penalty Law establishing the basis for liability for failure to return a known overpayment within 60 days of identification of the overpayment. Join our panelists as they discuss the issues surrounding these important provisions of the ACA that are rapidly evolving and are being reflected in numerous enforcement matters and in the regulatory priorities of the Centers for Medicare and Medicaid Services, the Office of Inspector General of Health and Human Services, and the Department of Justice.
